The usefulness of this book can be estimated by the fact that the new Brazilian Civil Code – Law no. 10,406/2002 – does not establish or explicitly determine business contracts categories. The provisions of this important law reveal that there is a distinguished treatment, arising only from the nature of the business activity, also taking into account principles of Commercial Law.
This work is the result of the dedication and objective vision of its coordinators (Asdrubal Franco Nascimbeni, Augusto Tavares Rosa Marcacini, and Maria Odete Duque Bertasi) and its authors on the needs of lawyers who work, drafting and reviewing contracts and advising their clients. It certainly offers a valuable contribution to the legal community and fills a gap in the specialized literature, since, as affirmed by U.S. lawyer and president James Madison, “Knowledge will forever govern ignorance; and a people who mean to be their own governors must arm themselves with the power which knowledge gives.”
